The pre-Christmas opportunity to settle
As we come up to this time of year, every client, insured, plaintiff, applicant, co-defendant wants a resolution. They want out if they can.
Defendants may just want it to but it depends what’s on the table…for all parties
The thing about this time of year is, there’s usually that little extra impetus for both sides to reach a resolution.
And that little window may be all that’s needed to get a result for your client.
Before establishing Brockhill & Usherwood Lawyers 6 years ago most of my career was as a legal mind in an insurance claims and broking world - getting amazing insurance and/or settling major claims for major insureds like ANZ bank, the industry super funds like Australian Super and working on major engineers insurance and claims.
Now as a lawyer in private practice, much has changed but not the goals. The method or intent in helping small - medium businesses and individuals settling insurance claims is the same, the same desire and relentless attitude.
Getting a result requires relentless hustle and any taking advantage of any opening to get an outcome.
To all my broker colleagues and friends, insurers and other lawyers. There’s an opportunity right now to bring proceedings and claims to an end. Let’s work proactively. Pick up that phone and make that call. Your clients will appreciate it. And if the deal is not on the deal is not on.
But we’re only in that Goldilocks period for a few more weeks!

If you have witnessed misconduct or corruption in the building and construction industry, there are substantial legal protections available to you under the Corporations Act.
Purchasing a professional indemnity policy does not guarantee you are covered. Without careful review of your policy wording, accurate completion of the proposal form and proper notification of circumstances that may give rise to a claim, your PI insurance may not respond when you need it most.
