Building and Plumbing Commission I have a question for you
With the concerns with plumbing issues in Victoria, including the recent drainage blitz finding a 1/3 of drains failed a recent audit:
When will the BPC implement recommendation 10 relating to plumbing insurance as stated in the October 2024 Weir Consulting Report ‘Victorian Building Authority – The Case for Transformation’?
Recommendation 10 requires that plumbing insurance products comply with the ministerial order and consumers are not being poorly treated by insurers.
This is a critical protection for consumers and ensuring plumbers have appropriate protection as well.
With the amount of non-compliance and given it has now been nearly 12 months since the issuance of the above report the new Building and Plumbing Commission should confirm that it will or is acting on this recommendation to demonstrate that Victorians will be protected by this important but somewhat dated Ministerial Order insurance.
This article is a general guide to the subject matter. Specialist advice should be sought about your specific circumstances.
A building professional who can write a report and a building professional who can defend one under cross-examination at VCAT are rarely the same person, and the gap between them is costing property owners claims.
If water from a neighbouring property has damaged your home or investment property in Victoria, section 16 of the Water Act 1989 gives you a direct path to recovery, but only if you can prove exactly where the flow came from and why it was unreasonable.
When a property damage claim moves toward recovery, the tradesperson who fixed the problem and the expert who can prove liability in court are rarely the same person.
