The problem of builders 'tapping the mat' in Victoria
Folks - we have had, still have and invariably will continue to have - a major problem with builders ‘tapping the mat’ in Victoria!
No more BS, this is a MAJOR MAJOR problem.
AND here goes another one… Major Victorian builder Grandeur Homes collapses
Everyday Victorians, whether they are choosing big or small builders, doing due diligence or not - they are facing major financial loss.
And a mass of other problems - after defects are discovered or insolvency occurs, including:
VCAT is painstakingly slow;
DBI can be difficult and convoluted to navigate especially with legal challenges;
VBA has been riddled with problems…
AND right when we need more homes built in Victoria.
SO! What STEPS, THINGS - ANYTHING are being taken by the Victorian government, VBA, VMIA or other authorities with a role to play!?
A DBI certificate from VMIA may not be enough in many cases and VMIA premiums have skyrocketed for all - good and bad alike!
Come on - tell me I am wrong!
This may be seen as another needless complaint… BUT for ALL we need action, I have seen enough clients disillusioned by a system they discover the hard way - AND worse still - I know - i KNOW I will see more in the same needless situations - MORE needs to be done.
We NEED more help for consumers.
This article is a general guide to the subject matter. Specialist advice should be sought about your specific circumstances.
Water ingress from common property is one of the most common apartment defect issues we see. Lot owners dealing with leaking roofs, balconies or plumbing failures have a range of remedies available against the owners corporation at VCAT.
If you have witnessed misconduct or corruption in the building and construction industry, there are substantial legal protections available to you under the Corporations Act.
Purchasing a professional indemnity policy does not guarantee you are covered. Without careful review of your policy wording, accurate completion of the proposal form and proper notification of circumstances that may give rise to a claim, your PI insurance may not respond when you need it most.
